SERVICE AGREEMENT

Lowest Commission Real Estate operates primarily under a capped commission model, currently advertised as a flat fee of $7,990 for the sale of residential properties.

2. Discretionary Adjustment of Commission

Notwithstanding Clause 1 above, in instances where the final contract sale price of the property exceeds $1,000,000 the Agent reserves the right, at their sole discretion, to apply an adjusted commission rate of up to 1.5% (inclusive of GST) of the final sale price.

 

3. Case-by-Case Assessment
Each property listing and sale shall be evaluated individually by the Agent, and the applicable commission—whether capped or adjusted—will be determined at the time of engagement, or as otherwise agreed in writing between the parties. The Agent shall exercise reasonable commercial judgment in determining the most appropriate fee structure based on the specific characteristics and circumstances of the transaction.

 

4. Fee Disclosure and Agreement
The applicable commission rate and fee payable for any individual sale shall be fully disclosed to the Client in the Form 6 Appointment to Act or other relevant written agency agreement prior to the commencement of services. By signing the appointment form, the Client acknowledges and accepts the agreed commission structure and the possibility of adjustment as outlined in these terms.

 

5. Exclusion of Liability
To the fullest extent permitted by law, the Client agrees not to initiate or pursue any legal proceedings, claims, or disputes against Lowest Commission Real Estate, its agents, or representatives in relation to the commission amount charged under this policy, provided the fee charged is consistent with the signed agency agreement and applicable real estate legislation in Queensland.

 

6. Compliance with Law
Lowest Commission Real Estate acts in accordance with the Australian Consumer Law (ACL) under Schedule 2 of the Competition and Consumer Act 2010 (Cth) and the Property Occupations Act 2014 (Qld). The Agent is committed to transparency, fairness, and full disclosure in all dealings and undertakes to ensure that all commission arrangements are clearly explained and agreed to prior to the provision of services.

You acknowledge that we have informed you prior to entering into this Agreement that the scope of the Products and Services, Marketing Upgrades and additional advertising Services as well as the Advertised Rates or other fees payable in respect of those services are negotiable.

A commission or fee is payable under this Agreement when the property has settled.
